Internal Review and Right to Appeal

Internal Review

If you make a request under the Freedom of Information Act (2021 Revision) and are not satisfied with the response provided by the Poinciana Rehabilitation Centre (PRC), you have the right to request an internal review of the decision.

Requests for an internal review must be submitted in writing within 30 calendar days of receiving the response to your FOI request.

Your request should include:

  • Your name and contact details
  • The FOI reference number provided in our response
  • A brief explanation of why you believe the decision should be reviewed

Internal review requests should be sent to:

  • Under Section 33 of the FOI Act, you may request an internal review if:
  • Access to the requested information was refused
  • You were granted partial access to the records requested
  • Your request was deferred
  • A request to amend or annotate personal information in an official record was refused
  • A fee was charged and you disagree with the amount
  • The decision was made by a person other than the Minister, Chief Officer, or Principal Officer of the public authority

PRC will review the original decision and provide a written response.

Appeal to the Information Commissioner

If you remain dissatisfied following the internal review, or where an internal review is not available, you have the right to appeal to the Information Commissioner.

The Office of the Information Commissioner is responsible for independently reviewing decisions made by public authorities under the Freedom of Information Act.
